BYLAWS OF THE SEA PORT OF PRIMORSK
I. General
1. The Bylaws of the sea port of Primorsk ( hereinafter referred to as the "Bylaws") were developed according to Federal Law of November 8, 2007 No 261-ФЗ "On sea ports of the Russian Federation and on amendments to particular legal acts of the Russian Federation" <1>, Federal Law of April 30, 1999 No 81-ФЗ "Merchant Shipping Code of the Russian Federation " <2>, General rules of ships navigation and anchorage at sea ports of the Russian Federation and approaches to them <3> ( hereinafter referred to as " General rules").

2. These Bylaws include the description of the sea port of Primorsk ( hereinafter referred to as "the sea port") ; rules of the ships entering and leaving the sea port; rules of navigation in the sea port waters; vessel traffic service zone description and rules of navigation in this zone; rules of ships staying in the sea port and indication of their berthing place; regulation of ecological safety; quarantine regulations in the sea port, rules of radio communication in the sea port and in theport waters; the sea port borders information; sea districts A1 and A2 borders information of the Global Maritime Distress and Safety System (hereinafter referred to as "GMDSS"); technical abilities information for ships calling at the sea port; information about navigation period; information on the districts of compulsory pilotage; the sea port waters depths information; dangerous cargoes processing information; information about ice navigation in the sea port and at the approaches to it; information transferred by captains of the ships staying in the sea port in the event of acts of unlawful interference hazards in the sea port; navigation and hydrometeorological information transferred to captains of the ships staying in the sea port; other information specified by normative legal acts of the Russian Federation related to merchant shipping.
3. These Bylaws are to be executed by ships of any national or departmental identity and by private or juridical persons of any organization legal form or propriety form working in the sea port.
4. Navigation of ships in the sea port and at the approaches to it and staying of ships in the sea port waters are carried out according to the General rules and the present Bylaws.
II. Sea port description
5 The sea port is located by the northeastern shore of the strait of B'yorkyozund of Gulf of Finland of the Baltic sea.
6. The sea port boundaries are determined by the Order of the Russian Federation Government of August 28, 2009, No 1244-p <1>.

7. Navigation in the sea port is performed all year round.
8. The sea port is available 24 hours a day; it has a checkpoint on the state border of the Russian Federation for international maritime cargo shipping <1>.

9. Navigation in the sea port is performed in the following hydrometeorological conditions:
south, southwest and west winds prevail;
sea water level is subject to non-recurrent fluctuation of wind-tide nature and has season changes: the minimum level is from March till May, beginning from June it raises and reaches maximum in October;
surge of the sea may reach 2.0 m with stormy south and southeast winds;
wind currents prevailing over constant currents, especially in autumn and in winter;
maximum ice thickness is up to 70-90 cm.
10. The sea port is a port which freezes over. When the sea port waters area is iced over, the ice-breaker assistance is available according to the General rules and these Bylaws.
11. Information on the fairways and recommended tracks of the sea port is given in Appendix No 1 to these Bylaws.
Information on the sea port technical parametres for ships calling at the port is given in Appendix No 2 to these Bylaws.
Information on the channels of Very High Frequency (hereinafter referred to as "VHF"), used for communication in the sea port, is given in Appendix No 3 to these Bylaws.
Information on places of anchorage in the sea port is given in Appendix No 4 to these Bylaws.
12. The sea port performs transshipment of oil and oil-products of Class 3 of dangerous goods prescribed by the International Maritime Organization (hereinafter referred to as "IMO"), and carries out cargo operations at berths assigned for other types of goods.
The sea port is available for double hull and double bottom oil tankers which conform to the requirements of Appendix No 1 to the International Convention for the Prevention of Pollution from Ships, 1973 <1>.

13. Passenger ships do not call at the sea port .
14.The sea port provides supply of ships with foodstuff, fuel, fresh water; from ships it performs reception of sewage and oily water, all kinds of garbage except wastes of Class 1 and 2 of dangerous goods.
15. Towage of ships in the sea port is provided:
for mooring operations;
for inbound and outbound oil tankers.
Information on minimum quantity and power of tugs for mooring operations in the sea port and for tug assistance to inbound and outbound oil tankers is given in Appendix No 5 to these Bylaws.
16. The sea port is part of operating zone of sea area A 1 of the Global Maritime Distress and Safety System (hereinafter referred to as "GMDSS").
17. Compulsory pilotage area in the sea port is located within the limits of the sea port water area.
18. The sea port is included in the list of the Russian Federation sea ports which may be entered by ships and other nuclear-driven crafts with radiation hazards <1>.

III. Rules of entering and leaving the port by ships
19. Information on ship's entering and leaving the sea port is reported to the Harbour Master on the website: www.portcall.marinet.ru.
20. Ships clearing in and out procedure is performed 24 hours a day.
IV. Rules of navigation in the sea port water area
21. A regulatory procedure of ships traffic and anchorage according to the schedule is carried out in the sea port. The schedule of ships traffic and anchorage in the sea port waters is approved by the Harbour Master daily and is based on the information about the ships calling at the sea port, which is reported in compliance with item 19 of these Bylaws and requests of the berth operators, and placed on the website:www.pasp.ru.
22. Ships traffic in the sea port waters and all the procedures of going to anchor and leaving the anchorage are regulated by the Vessel Traffic Service (hereinafter referred to as "VTS") according to the schedule of traffic, anchoring and berthing in the sea port.
23. Traffic of inbound and outbound ships in the sea port is carried out along fairways Nos 5a, 5b and 5 and recommended track No 2.
24. Navigation along fairway No 5a in the sea port waters is performed at a speed not exceeding 10 knots.
25. When navigating at a distance less than 200 metres from the ships lying at berth and at anchor, passing the places of submarine and diver's work, ships speed should be decreased to minimum possible to provide safe navigation.
26. Ships traffic and mooring operations in the sea port in visibility less than 5 cables is prohibited with the exception of navigation and mooring operations of vessels engaged in salvage operations.
27. Ships engaged in operations for service and supply of vessels in the sea port waters and at the approaches to it, sea port facilities (hereinafter referred to as "port fleet vessels"), small ships, sport sailing vessels and pleasure boats should not hinder oil tankers traffic .
28. Pilot embarking and disembarking is available:
for ships lying at berth and at anchorage in the sea port - at berths and at anchorage places;
for ships entering the sea port from south or for ships leaving the sea port southward - in position Lat.60°11,8' N., Long. 028°44,7' E;
for ships bound for the strait of B'yorkyozund from northwest along fairway No 5 to the sea port berths, northwestward of the sea port berths or as transit through the sea port waters in southeast direction - in position Lat. 60°22,40' N., Long.028°34,54' E;
for ships bound for the strait of B'yorkyozund from southeast along fairway No 5 to the sea port berths, from the sea port berths to southeast or as transit through the sea port waters in northwest direction - in position Lat. 60°14,75' N., Long.028°50,84' E.
29. Small vessels, except port fleet vessels, sport sailing vessels and pleasure boats, in the sea port are prohibited to:
approach the vessels lying at berth or at anchor;
approach the berths of oil tanker terminal;
navigate at wind speed more than 15 m/sec;
navigate in the anchorage areas;
make fast to floating and fixed navigation facilities and to anchor close by them;
anchor on the fairways and close by them.
30. The vessels mentioned below are exempted from compulsory pilotage :
small vessels;
sport sailing vessels;
port fleet vessels with gross tonnage less than 500;
ships engaged in coastal fishing.
V. Description of operating zone of Vessel Traffic Service
and rules of navigation in this zone
31. The Regional Vessel Traffic Service (hereinafter referred to as "RVTS") which includes the sea port VTS, operates in the eastern part of the Gulf of Finland port waters, limited by Long.26°30,00' E within the territorial sea of the Russian Federation.
Communication with RVTS is performed 24 hours a day on Channels 74 and 10 of VHF, call sign is "Petersburg - Traffic".
32. The operating zone of the sea port VTS covers :
the strait of B'yorkyozund water area southward of Lat. 60°25,00' N.;
Gulf of Finland water area between the arc with a radius of 16.5 nm with a center in position Lat. 60°20,25' N., Long. 28°43,23' E and its radii in the direction of 130° и 225°.
33.The bound of ships' crossing from the RVTS operating zone , call sign "Petersburg-Traffic", to the sea port VTS zone, call sign "Primorsk-Traffic", is the bound of the sea port VTS operating zone.
34. Communication with VTS in the sea port is performed on the VHF channels given in Appendix No 3 to these Bylaws. All ships in the sea port VTS operating zone are to maintain a listening watch on VHF Channels Nos 16 and 68.
35. When entering the sea port VTS operating zone, ships are given permission of RVTS to stop keeping a listening watch on VHF Channel 10, call sign "Petersburg - Traffic" and contact the sea port VTS on VHF Channel 68, call sign "Primorsk - Traffic".
36. When leaving the sea port VTS operating zone, ships are given permission of the sea port VTS to stop keeping a listening watch on VHF Channel 68, call sign "Primorsk - Traffic" and contact RVTS on VHF Channel 10, call sign "Petersburg - Traffic".
37. Before starting traffic a vessel is to make an inquiry about the sea port VTS permission for traffic clearance. Information about the ship's traffic clearance is reported to the Harbour Master by the sea port VTS .
The permission is cancelled by the sea port VTS and is to be inquired once again if during 30 minutes after getting clearance the vessel did not start traffic.
38. Ships traffic in the sea port VTS operating zone is not allowed if there is no communication between a ship and the VTS .
VI. Rules of ships' staying in the sea port and indication of their anchorage
39. Ships' staying in the sea port is available at anchorages Nos 6, 6a,10 and at the sea port berths.
40. With the beginning of ice formation in the strait of B'yorkyozund , oil tankers staying at anchorage No 10 is prohibited.
41. Staying of ships in two hulls is available at berths Nos P1, P3.
42. When staying at berth, an oil tanker must lower to the water and fasten its wire ropes with eye splices on the forecastle and on the stern from offside.
43. Mooring of port fleet vessels to an oil tanker lying at an oil pier to carry out bunkering operations or reception of ship wastes (oily and waste water, garbage) is available without tug assistance.
44. Mooring of ships and crafts to the piers of oil tanker terminals is not permitted.
45. Mooring to the sea port piers is prohibited:
with south winds direction from 140° to 230° at a wind speed exceeding 15 m/sec;
with wind direction 230° - 0° - 140° at a wind speed exceeding 18 m/sec.
46. Ships mooring to berth No 4 is permitted at a wind speed less than 15 m/sec.
47. Ships unmooring from the berths is permitted at a wind speed less than 20 m/sec.
VII. Rules of use of special means of communication
on the sea port territory and in port waters
48. Ships anchored in the sea port waters and lying at sea port berths must maintain a listening watch on VHF Channel 68.
49. Information on extra means of communication, including telephone numbers, is to be notified to mariners by the Harbour Master.
50. Using VHF Channels listed in these Bylaws for communication between shore-based persons is prohibited.
VIII. Information on the bounds of sea areas A1 and A 2
of the Global Maritime Distress and Safety System
51. In the sea port waters there are sea areas A1 and A2 of GMDSS which are informatively connected with Rescue Coordination Centre "Saint-Petersburg".
52. The bounds of GMDSS sea area A1 are outlined with operating radius of 150 nm centered at Rescue Coordination Centre in Saint-Petersburg in position Lat. 59°53,00' N ., Long. 030° 13,00' E westward.
53. Communication in the GMDSS sea area A2 is provided by joint work of shore stations of Saint-Petersburg, Gorki, Karavaldaysky peninsula with operating radius from 200 nm to 250 nm centered in position Lat. 59°59,00' N., Long. 29°07,00' E.
IX. Rules of ecological safety and quarantine in the sea port
54. The sea port provides reception of ships sewage and oily water, all types of garbage, except wastes of dangerous goods Class 1 and 2.
55. Discharge of segregated ballast in the sea port is permitted if the ballast was taken on board in the Baltic sea, taken or replaced in the area of North-East Atlantic, in the North sea if the distance from the nearest land was not less than 50 nm and in areas with sea depth not less than 200 m; each operation shall be recorded in the ship's record book.
56. In the event of oil or petroleum products spill on board the ship or in the sea port water area during bunkering operations, the procedures are to be stopped and measures to localize oil and petroleum products spill are to be undertaken according to Oil pollution emergency plan.
Information about the sea port water area oil pollution is to be immediately reported to the Harbour Master on VHF Channel 68 giving the details such as:
time when the oil or petroleum products spill was discovered;
hydrometeorological conditions (sea state, wind speed and direction, visibility);
nature of pollution and extent of oil outflow area;
supposed source of pollution.
57. Ships not engaged in oil pollution prevention operations are prohibited to cross the polluted sea port water area.
58. When passing close to the area of operational oil or petroleum products spill response, a ship shall reduce her speed to minimum to steer the ship safely.
59. During oil handling and bunkering operations ships shall be guarded with booms.
Booms are not to be installed :
at a wind speed exceeding 15 m/sec;
at wave height over one meter;
during ice formation.
When booms are not installed, near the berth there should be provided a watch of the vessel (a tug) equipped with clean-up devices for oil pollution prevention.
60. A ship with a sick person on board with symptoms suggesting a dangerous infection is to be moored at quarantine anchorage No 6 with all the crew, passengers and cargo for epidemic preventing procedures.
X. Information on the sea port technical parameters for berthing
and the sea port waters depths
61. The sea port is available for ships not more than 307 m in length, breadth - up to 55 m and draught - up to 15.85m.
62. Information on technical parameters of the sea port for ships berthing is given in Appendix No 2 to these Bylaws.
63. The Harbour Master notifies the mariners of information about the exact depths in the sea port waters and at the sea port berths and specified draughts of ships annually and in the event of any changes on the website: www.pasp.ru.
XI. Information on dangerous cargoes handling
64. The ship's mooring place at the delivery manifold station of oil tanker pier is defined by the sea terminal operator.
The ship's master should control the tension of mooring lines and ship's location.
65. In the event of threat of damage to the delivery manifold station, oil handling is to be stopped and manifolds disconnected.
66. Carrying out oil and petroleum products handling operations at berths Nos 1-4, Nos 8-9 is permitted at a wind speed not exceeding 22 m/sec.
XII. Information on ice navigation in the sea port
67. The period of ice-breaker assistance to ships in the sea port starts in the beginning of ice formation in the strait of B'yorkyozund and completes when this strait is finally free of ice.
68. Start and completion of ice-breaker assistance period for ships in the sea port waters and approaches to it are announced by the Harbour Master.
69. To provide ice-breaker assistance to ships in the eastern area of the Gulf of Finland the Ice Operations Headquarters is set up.
70. Information about the ship's Expected Time of Arrival at the Convoy Meeting Point (hereinafter referred to as "CMP") is sent 72 hours in advance and confirmed 24 hours prior to the expected arrival at CMP according to item 19 of these Bylaws.
The schedule and place number of ships passing the ice as well as the number of ships convoyed at the same time are arranged by the Harbour Master at 1000 hrs daily and given on website: www.pasp.ru. In the event of any changes in ice situation and necessity to update the information, the time and order of ships passing the ice should be specified by 2000 hrs daily and placed on the website.
71. Depending on the ice situation forecast in the sea port waters, the Harbour Master is to impose ice navigation restrictions in ice conditions according to Appendix No 6 to these Bylaws. A notice of ice navigation restrictions and location of CMP is given on the website: www.pasp.ru not later than 14 days before the supposed date when restrictions and CMP location data come into force.
72. Incoming ships are to approach CMP using instructions of RVTS. The ships unable to approach CMP without assistance are provided with ice-breaker assistance on request of their shipowner (captain of the ship). A ship proceeding in ice conditions to or out of the sea port with ice-breaker assistance shall ensure manual mode of the main engine control whenever necessary.
73. Ice-breaker assistance is effected by linear ice-breakers and port ice-breakers in ice convoy. In the event a vessel is unable to proceed in ice convoy, it shall request an individual ice-breaker assistance which is arranged upon availability of ice-breakers not engaged in ice convoy.
74. Ice-breaker assistance is effected along Fairways Nos 5a, 5ь or Recommended tracks Nos1and 2.
75. The ice convoy for ships bound to the sea port is formed by the Harbour Master according to item 70 of these Bylaws, depending on:
time of ship's approach to the sea port;
time of request submission for entering or leaving the sea port;
priority order of ships' place established by General Rules;
ice restrictions conditions .
On arrival at CMP ship is to come into VHF radio contact with an ice-breaker and act according to its instructions. VTS is to assist ships to contact the ice-breaker in case of necessity.
76. Depending on the actual ice conditions in the sea port waters and ships technical characteristics, ships may proceed their route without assistance using VTS instructions.
Ships proceeding without ice-breaker assistance shall report to VTS about passing waypoints on the route recommended by VTS and the ice situation on the route.
77.Ships included in ice convoy are to change VHF channels at the command of the ice-breaker conducting the convoy.
78. Ice around the nipped vessels is to be split off only by an ice-breaker.
79. Vessels must be provided with fuel, provisions and fresh water for the period of not less than 14 days from the time of arrival at CMP to enter the sea port. Should a vessel be waiting for ice-breaker assistance more than 14 days from the time of arrival at CMP, the Harbour Master is to take proper measures to conduct the vessel to the sea port.
XIII. Information on the reports of captains of ships staying in the sea port
in case of threat of acts of unlawful interference in the sea port
80. In case of any hazard of act of unlawful interference in the sea port, ship's captain or ship's security officer without delay is to report it to the port facility security officer as well as to the Harbour Master.
81. The Harbour Master is notified of security level of port facilities and ships staying in the sea port and any changes in their security levels.
82. Announcements about hazards of unlawful interference acts in the sea port, changes of ship's security level and confirmation of reception of these announcements are made immediately on VHF channels after the announced circumstances occur.
83. All the incidents related to finding precarious objects or explosive mechanisms, the signs of preparing and realizing unlawful interference acts, facts of illegal boarding, receiving any information about facts of preparation for terrorism, any infractions of order or presence of dubious strangers in the sea port are to be immediately reported by the captains of ships staying in the port to the Harbour Master and the port facility security officer on VHF channels or via additional means of communication. This information is brought to notice of all concerned persons by the Harbour Master .
XIV. Navigation and hydrometeorological information for captains of ships staying in the sea port
84. Transmission of hydrometeorological information for ships staying in the sea port is performed daily at 1300hrs on VHF working Channel 68.
85. Transmission of hydrometeorological and navigation information to ships in the operating zone of the sea port VTS is performed by the sea port VTS on VHF working Channel 68.
86. Storm warnings (reports of unfavourable hydrometeorological conditions) shall be transmitted immediately by VTS on VHF working Channel 68 or reserve Channel 9. Ships are to confirm to VTS the reception of reports of special importance and storm warnings.
